Terms of service

These Terms of Service govern purchases from and use of Hilliard Made’s online store and related services.

By using the store, submitting artwork, placing an order, or approving a proof, you agree to these Terms and to the policies referenced below.

READY-MADE PRODUCTS

Hilliard Made also sells non-custom ready-made products, including seasonal
sticker packs. These products do not require customer artwork, proof approval,
or production authorization. Terms addressing customer artwork, proof approval,
and custom production apply only to customized products. Shipping, cancellation,
and return conditions for ready-made products are described in the Shipping
Policy and Refund Policy, and any product-specific disclosures, subject to
non-waivable legal rights.

Custom Products

Hilliard Made produces custom and made-to-order products.

Product appearance, dimensions, color, finish, cut placement, material characteristics, and other physical details may have reasonable production variation.

Hilliard Made may decline or cancel an order before production if:

  • We cannot reasonably produce the requested product
  • Required artwork or information is missing
  • There is a material pricing or listing error
  • Submitted content appears unlawful or infringing
  • The order presents a legitimate business, safety, or production concern

If Hilliard Made cancels an order that we do not produce, amounts paid for that canceled order will be returned as required by applicable law.

Artwork and Proofs

Customers are responsible for supplying accurate artwork and order information and for reviewing proofs carefully.

Proof approval authorizes Hilliard Made to proceed with production.

By approving a proof, you confirm that you have reviewed and accepted the applicable details, including:

  • Artwork
  • Spelling and wording
  • Layout
  • Size
  • Quantity
  • Finish
  • Product type
  • Other selections shown or provided

Hilliard Made is not responsible for customer-provided errors that are reproduced consistently with the approved proof.

Changes requested after proof approval may not be possible. If changes can be made, they may result in additional charges and a revised production estimate.

Rights to Submitted Artwork and Content

By submitting artwork, logos, trademarks, photographs, text, designs, or other content, you represent that you own the content, have permission to use it, or otherwise have the legal right to reproduce it.

You authorize Hilliard Made to reproduce, resize, modify as reasonably necessary for production, store, and use submitted content as reasonably necessary to:

  • Prepare proofs
  • Produce your order
  • Fulfill and ship your order
  • Maintain approved artwork for reordering
  • Provide customer account and reorder functionality
  • Maintain reasonable business and order records

You are responsible for claims or losses arising from submitted content when you did not have the right or permission to use that content.

Pricing, Payment, and Product Information

Prices, product options, materials, availability, and specifications may change without notice before an order is placed.

Hilliard Made may correct typographical, pricing, configuration, or product-information errors.

Payment does not override proof approval requirements, artwork requirements, or other reasonable production requirements.

Customers are responsible for providing accurate:

  • Contact information
  • Billing information
  • Shipping information
  • Artwork
  • Order specifications

Production and Delivery Timing

Production timing begins after proof approval and after Hilliard Made has received the information and artwork reasonably needed to produce the order.

Any production, turnaround, shipping, or delivery time is an estimate unless Hilliard Made expressly agrees to a specific deadline in writing.

Hilliard Made does not guarantee completion or delivery by a particular:

  • Event
  • Promotion
  • Holiday
  • Business opening
  • Meeting
  • Deadline
  • Other requested date

Delays may result from factors including:

  • Proof revisions
  • Workload
  • Equipment issues
  • Material availability
  • Supplier delays
  • Carrier delays
  • Severe weather
  • Utility or internet outages
  • Other circumstances beyond our reasonable control

Product Appearance and Color

Colors displayed on phones, monitors, tablets, and other screens may differ from the finished printed product.

Hilliard Made does not guarantee an exact color match between:

  • A digital display
  • A digital proof
  • A prior print run
  • Customer-supplied artwork
  • The finished product

unless a specific color-matching standard or service has been expressly agreed to in writing.

Reasonable variation in printing, cutting, finishing, placement, dimensions, and appearance may occur and is not necessarily considered a defect.

Product Performance and Durability

Hilliard Made does not guarantee that a product will be compatible with every surface, environment, application, or intended use.

We do not guarantee a particular:

  • Adhesion period
  • Outdoor lifespan
  • Weather resistance
  • Wash resistance
  • Fade resistance
  • Scratch resistance
  • Magnetic performance
  • Overall service life

Product performance can depend on material, installation, surface preparation, handling, temperature, moisture, sunlight, chemicals, cleaning methods, environmental exposure, and other conditions outside Hilliard Made’s control.

Returns, Refunds, and Shipping

Returns, exchanges, cancellations, production errors, and refunds are governed by our Refund Policy.

Production timing, transit, shipping addresses, lost packages, damaged shipments, and delivery matters are governed by our Shipping Policy.

Those policies form part of these Terms of Service.

Website and Third-Party Services

Hilliard Made may use third-party platforms, applications, payment processors, file-upload services, carriers, and other service providers.

We do not guarantee uninterrupted or error-free access to:

  • The website
  • Customer accounts
  • Artwork upload systems
  • Proofing systems
  • Reorder features
  • Payment services
  • Third-party applications

Hilliard Made may modify, suspend, or discontinue products, services, website features, or store functionality when reasonably necessary.

Disclaimer of Warranties

Except for obligations expressly stated in these Terms or rights that cannot legally be excluded, Hilliard Made does not make additional express guarantees or warranties regarding custom products, production timing, delivery timing, compatibility, durability, or service life.

To the fullest extent permitted by applicable law, products and services are provided subject to the limitations described in:

  • These Terms
  • The applicable product description
  • The approved proof
  • The Refund Policy
  • The Shipping Policy

Limitation of Liability

To the fullest extent permitted by applicable law, Hilliard Made will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including:

  • Lost profits
  • Lost business
  • Lost opportunity
  • Lost advertising value
  • Event-related losses
  • Losses resulting from production or delivery delays

To the fullest extent permitted by applicable law, Hilliard Made’s total liability arising from an affected order will not exceed the amount actually paid to Hilliard Made for that affected order.

These limitations do not apply where applicable law does not permit them.

Events Beyond Reasonable Control

Hilliard Made is not responsible for delay or failure caused by events beyond our reasonable control, including:

  • Carrier disruptions
  • Severe weather
  • Natural disasters
  • Utility outages
  • Internet outages
  • Equipment failures
  • Supplier shortages
  • Government actions
  • Labor disruptions
  • Similar events outside our reasonable control

except to the extent applicable law provides otherwise.

Governing Law

These Terms are governed by the laws of the State of North Carolina, without limiting any mandatory consumer rights that apply under applicable law.

Changes to These Terms

Hilliard Made may update these Terms from time to time.

The version posted at the time an order is placed will generally govern that order unless a change is required by law or agreed to by the parties.

Legal Rights

Nothing in these Terms limits any right or remedy that cannot legally be waived or limited.
